Murder (First & Second Degree)
Under California Penal Code 187, murder is the unlawful killing of a human being with malice aforethought: either a deliberate intent to kill or a reckless disregard for human life. First-degree murder requires premeditation and carries 25 years to life. Second-degree murder carries at least 15 years to life. Special circumstances such as multiple victims or the killing of a peace officer can elevate a charge to capital murder, which carries life without parole.
Felony Murder
California’s felony murder rule under Penal Code 189 can charge a defendant with murder even when death was unintentional, if it occurred during a qualifying felony like robbery or burglary. The law here is technical, and the facts matter enormously to any defense.
Manslaughter
Penal Code 192 covers voluntary, involuntary, and vehicular manslaughter. Voluntary manslaughter, often charged in heat-of-passion situations, carries up to 11 years. Involuntary manslaughter carries up to 4 years. Vehicular manslaughter can be charged as a misdemeanor or felony, with felony convictions reaching up to 6 years. Any manslaughter conviction can count as a strike under California’s Three Strikes Law.
Attempted Murder
Charges under Penal Code 664/187 require proof of intent to kill and a direct step toward carrying it out. Attempted first-degree murder that is willful, deliberate, and premeditated can result in a life sentence. Attempted second-degree murder carries 5, 7, or 9 years.
